A co-owner of real estate property may file a partition action to address issues related to shared ownership of the property. If it is possible for the property to be physically divided into distinct portions, a court may order a partition in kind. If a physical division would not be practical, the court may order a partition by sale, which will require the property to be sold. In a situation where one party has the resources to assume sole ownership of the property, they may pursue an allotment action in which they will buy out the other co-owners' shares.
